NYC - It was an accident waiting to happen -- an open sewer and a 15-year-old girl who was texting while she walked.

Alexa Longueira, a high school sophomore, was walking along Victory Boulevard near Travis Avenue on Staten Island Wednesday evening when she felt the earth move and was plunged into smelly darkness.

She said the manhole she fell in to was left open and unattended with no warning signs or orange cones. She said two workers with the New York City Department of Environmental Protection failed to secure the area as they prepared to flush the sewer.

Those dumb bastards. How dare they expect me to watch where I'm going. Don't they know I can't see a 3 foot diameter hole hidden in the middle of sidewalk. I'm going to sue them! I'm going to sue the city! And I'm going to sue my friend who was walking with me and didn't warn me!

I will rain down on them an ungodly firestorm. We're talking scorched earth motherF#@*ker!!

What rubs me the wrong way is people crying a river for the ones creating the problem. I'm citing more serious instances but feeling for criminals like the Libyan bomber or Susan Akins while forgetting the people they killed in cold blood is twisted to put it mildly. OK, the manhole case is nothing like that but the sympathy is still screwed up.

The cover should have been on, but if this teen can't chew gum and walk, she should not walk and text either.

As outrageous as it sounds, I'm sure she'll win in NYC. She won't in Peoria, but she will in the Big Apple, because they are famous for getting sued and losing...

Whoa guy settle down. I can't believe I was only the second person to say she should get damages.

WHAT IF SHE WAS BLIND????

Regardless of what she was doing, unless she jumped in, she was allowed to fall into an open manhole. Point blank.

Sue them? For every penny.

Letting people sue over stuff like this is why America has the most lawyers per capita and a dime on every dollar we pay is for legal CYA.
