Woooooow.
This guy was found hiding under a car with $129 stuffed in his pocket.
Early arrest for sexual assault
Close Friend of the guy he claimed was the actual killer
Saw his buddy "struggling" with the victim-immediately rendered aid-just joking of course he ran off with $129 in his pocket-left victim bleeding to death.

He initially didn't tell the cops anything about the guy-his buddy-who he claims was the actual killer.
This was why he took the full fall-covered for his buddy-got a Darwin Award.
Sounds like he was at least an accomplice-which makes him fully guilty.
He just happened to be with the "real killer" a buddy-5 minutes before the robbery- but he didn't know it was going to happen??

There are several problems with what happened. I think the root of it probably is that both the victim and the accused were from marginalized groups, so the folks in Tx law enforcement could get away with corner cutting. The retarded guy who was executed was a victim of injustice, but so was the community that the real killer terrorized for years afterwards.

Read McCarthy's oeuvre it's freaking brilliant...appropriate for this thread it's mainly set in the southern US with forays into Mexico as the people and values of the frontier face modernity: it snatches beauty, honor, truth and hilarity from the jaws of the darkest human depravity. The Road contains his starkest prose, the depth of his writing and vocab in of most of the other works are stunning. Suttree, Blood Meridian, All the Pretty Horses, Child of God...can't go wrong.

Why don't you think he was an accomplice?
1)Buddy of the guy he said was the killer
2)He admits to being with the "killer" a few minutes before the crime
3) Says he saw the killer "struggling" with victim
4)Found hiding under truck with $129 in pockets-bills apparently roughly the distribution you would find in a mini mart type gas station-no convincing explanation for bills-no one said "I just paid him", or he just went to bank-nothing
5)Did not render aid to victim despite seeing her being savaged-screaming-I wonder why he didn't?
6)Did not immediately rat out the "real killer" once again-I wonder why-best answer he was an accomplice-these lawyers say he was scared of real killer

He was an accomplice to this crime-didn't turn on his buddy quickly enough-because he was an accomplice-and the accomplice is fully guilty so initially it would have been self defeating to turn on him.
Yeah this guy didn't rat out his buddy until late in the game-and didn't give the guys full name-
His own lawyer in the 1st trial didn't feel he was unjustly convicted- of course only a really moral lawyer would admit he lost a case where an innocent client was put to death.

The other guy might very well have been the stabber-but strains belief that he didn't know what his criminal buddy was up to 5 minutes after he claims they split up-
Death penalty is probably a waste of resources-jobs program for lawyers cops judges-so I have no strong feelings about keeping it-and it requires otherwise good folks to kill people in cold blood-so its time has passed.

You have a good point there, enough of it that the jury decided to ignore the shoddy police work. Perhaps common sense won the day.

The POSSIBILITY of executing the wrong person is the ONLY reason I am against the death penalty. The guilty scumbags on death row deserve it.
