I was driving my Metro through the middle of town on the main road and watched as a car runs a red light to my right and in front of me . The car totally blew through the light and turns right. It is now directly in front of me. We both get in the left turn lane behind another car to turn onto a 4 lane median divided road.

Our light turns green, all three cars turn left onto the right most lane, the first car is doing 20mpg and I pull out to pass the two cars in front of me. Speed limit is 35mph. I'm doing 30-32. This is a two lane one way road that goes through a big development. The light runner drops in behind me fast and follows close, I signal to pass the front car and as I'm changing lanes the light runner tries to accelerate and squeeze in between me and the other car. Bad move.

There isn't enough room for both of us so the light runner hits the gas and hits the passenger side front fender, wheel and tire, running light and front bumper of my Metro with their drivers side rear fender and wheel. The light runner takes off and turns right into the developement, I follow.

The hit and runner (upgraded status from light runner) takes the next left and I follow, I'm not going fast as I've got the license plate number and I'm calling 911 and just poking along trying to feel if the damage is bad to my car. I come to a good place to pull over and give details to the 911 dispatcher. I get transferred to the police department dispatch and I'm telling the dispatcher what happened. I'm sitting in my car on the corner of an intersection with a road to my right. As I'm telling the dispatcher what happened I see the hit and runner :woot: back out of the driveway of the second house on my right and take off with the lights on long enough for me to confirm the plate number. Lights go off. I tell the dispatcher, they assure me that a patrol car is on its way. About a minute later the car comes back :eyebrow: and pulls into the driveway of the first house on my left. Lights are still off. :confused: A 20something woman gets out and walks back to the second house (on my right) goes inside for about 10 seconds, comes back outside with a man, she walks back to the car at the first house (on my right) , gets in, backs out and pulls back into the second house. I'm telling the dispatcher all this while it happens. I'm completely visible to the hit and run driver the whole time.

She gets out of her car and waves at me as she and the man are standing in the driveway.

The patrol car gets there seconds later and asks her who was driving the car. The woman tells the officer that the man was driving, the man doesn't say anything. The woman is hysterical and the officer says to the woman you've been drinking. She repeatedly tries to get the man to say he was driving. The man is trying to ask what is going on. He probably doesn't know she hit my car yet. There is the back and forth between the officer, man and woman. I just listen. The officers threatens to arrest them both and she finally admits to being the driver, she admits to hitting my car and driving off (man walks over to their car and looks at damage), she says she was scared and drove off, she says she got home, went inside and had two glasses of wine and that is why she spelled like alcohol (she was in house for 10 seconds...quick drinker :rolleyes:)

Even if she did have those two unlikely glasses of wine in 10 seconds I still saw here back out of the first house and pull into the driveway of the second house after her wine slam fest.

She gets arrested for misdemeanor DUI and misdemeanor hit and run. I go by the station after work (1AM) to turn in my statement. The Captain, who was the second patrol attending the call earlier tells me that most likely when her insurance pays for my damages and if she pleads guilty to the DUI they will drop the hit and run. I ask about the charge for running the light and he said he advised the first officer not to charge her for it. :(

She is in jail tonight, I have a dented fender, broken running light, scuffed and misaligned front bumper cover and my alignment is off more than before. I figure all damage including a new tire (it was new about a month ago anyway) should amount to about $700-$800 dollars in repairs. Her car has a dented rear fender and scuffed rear tire with metro makeup on it.

I can go by the police station Monday, pick up the accident report and get the damage appraised.

At least no one got hurt. It would have become a felony hit and run and I would be pretty sore. :p - Dale

Wow, Dale, you do have some crazy stories. But I'm not surprised being you live in my area. I think we have some of the worst drivers here. Everyday my wife and I have a jerk or 2 of the day to talk about.

Did you get her insurance info? She doesn't seem like the type to report the accident herself.

Caught driving
Caught driving AGGRESSIVELY


At worst, she's going to get a fine, right? Why NOT press every possible charge?? She should not be driving now, nor 5 years from now, or someone is going to end up dead (and it won't be her).

Oh man, Dale!! :( I hope you can get your vehicle fixed quickly and I also hope things get worse for that other driver very quickly. She obviously shouldn't be anywhere near the operating controls of any motor vehicle. :(

First of all, i am glad you are unhurt.
I am encouraged by one line in your post.

"She is in jail tonight"

Hopefully, some time in a cell will make her think twice or thrice about such douche bagette behavior.

I'm glad everything worked out and she got what was coming to her. That DUI is going to cost her some serious cash. Between the fines, classes, suspended licence, plus her insurance rates are going through the roof for the next four to five years, she is going to pay out some serious cash for her drinking.

You know the thing that bothers me the most is her insurance will pay for my car, she will get the DUI, face the fines and rate increase but nothing else. There will be no record of her running the light while DUI or hit and run while DUI. She was using her car as a tool of intimidation, it was larger and easily more powerful.

She was unrepentant in the 20-30 minutes I was there with the officers. She, before she was arrested and her husband immediately afterward were grasping at any opportunity for her to not be held responsible for any of her actions. So the likelihood of her doing this again is very high. If the next vehicle is a motorcycle or she hits someone head on or T-bones them, there will be injuries. I would really like to see the hit and run go on her record.

See, now, that's the part the troubles me. I wonder if she has a history of this? And why are the police reluctant to press charges? Gah, let's put someone that has no regard for anyone but themselves (drunk no less) back on the road please.

Money is more important than justice? I think that it should be up to the district attorney to decide what charges she should face in court. The officers should present all of the facts, charge her with all infractions and let the court decide what is appropriate. I don't want to see her life ruined but I don't want her to hurt someone in the future.

I'll speak to the captain about his decision to not include running the red light that I witnessed before the accident, when I go down to get the police report Monday. Maybe he can enlighten me as to why he reached that decision. - Dale

Good chance she/they will loose their insurance too. Hope the police follow up and act correctly if they find her driving without insurance.

Glad your alright and that everything is working out as well as it is for you. To bad its not working out a bit worse for her.

Got the police report today. Her blood alcohol content was .21

I didn't get to speak to the Captain. There is no mention of her running the light.

I call her insurance company tomorrow.

I would guess that the police would be more interested in the hit and run since it likely would be easier to prove (and probably annoys them). Does the report mention that?

Charged with DWI and Hit and Run.

Called her listed insurance company. They say they don't "show" a policy for this person. Filed a claim with the company anyway so they could investigate. Left message with arresting officer to contact me about her possible lack of insurance.

Initial claims rep said there were not enough digits in policy number to be accurate. The investigating insurance rep should be able to look it up by name and drivers license tomorrow.

Not really worried about it. It will work out in time.
